The Demise of the 28-Clause Peace Initiative for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension sparked by the introduction of a new 28-point plan for ending the war appeared – briefly – to have been defused. A American diplomat spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, Moscow made its countermove: another massive barrage of rocket attacks on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of conflicting incidents captured the bleak nature of the current period. By day, negotiation efforts are fought: hopeful statements are issued from different nations. Significant resources is expended on managing specific proposals. By night, the Kremlin forcefully demonstrates the world that, for them, conflict continues to be the main instrument for achieving "settlement".

Nighttime Reality

As military strikes developed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was laid bare. Ukraine is equipped to monitor projectile deployments from Russian territory, a capability provided through current data. From vantage locations, defense planes that had been dispatched to intercept incoming guided weapons flew past – modern combat jets delivered to Ukraine by European allies.

Moments later, Kyiv's air-defence systems activated: multiple launches fired to intercept a incoming threat. This was a modern interception technology at work, most likely provided by Western nations. Every firing jolts you unexpectedly, rattling buildings. The moment of terror quickly becomes resigned acknowledgment: possibly the hostile projectile won't strike its target this time, preventing destruction from catastrophe and another blackout.

Continuous Dangers

Soon after, a large-caliber weapon engaged a unmanned aircraft close by, part of a defensive team – probably Western-made equipment. Sadly, the bullets missed the opposing UAV – it pressed on overhead toward its destination.

Periodically, this persisted until dawn. Kyiv greeted the morning news: seven people killed, devastation and utility failures in many homes as a result of the night's assault. As customarily, everyone still went about their day – enduring hostilities. But those full day encapsulated Ukraine's critical military reliance on international aid – a reliance that regional partners are evidently unprepared to substitute in the near term.

Unsuccessful Negotiations

The comprehensive proposal from US administration generated strong feelings, controversy and serious worry – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and multilateral gatherings.

Every new approach from Washington follows the same pattern: a political offensive against Ukraine, which Kyiv, with partner nations, manages to fend off. They stabilise the situation but never actually win the battle. This pattern will, undoubtedly, continue.

Political Considerations

It is convenient to criticize certain parties of consistently pushing Kremlin's demands. But that does not seem to be the whole story. American leadership operates on a premise familiar among seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The White House assumes that it is unfeasible to force Russia to abandon the land that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while accepting these circumstances, US leadership does minimal to deter Moscow, through diplomacy or military means, from believing that the situation will not shift further in its benefit in the coming year.

Divergent Views

Therefore, Moscow is certain that duration works to their advantage – that Ukraine and its allies are nearing depletion. Their reason to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be multiple initiatives to end hostilities, but they will continue as long as Russia's leader remains completely certain in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, gradually sacrificing civilians and areas but preventing a entire defensive failure until conditions improve in its favour.

Present Conditions

Factually, there are no real preconditions for a truce. Now, subjective factors are entering the equation: political desires to negotiate peace and achieve global acclaim, and Ukrainian leadership's double obstacles – on one hand, not to alienate a key ally, and on the other, to unite the population around the flag against any plan Kyiv finds unsuitable, so that their attention does not move to internal issues. And although their task will now be significantly challenging after current events, it remains very improbable that this will modify their basic position.

These conflicting dynamics are driving the talks.

Assessment and Future

It took a mere seven days to terminate the 28 points of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the remaining European nations, along with soothing efforts of diplomats, and finally, latest revelations, all did their job.

While new proposals based on previous concepts are approaching, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are founded on Moscow's terms and reflect certain reluctance to alter the situation, if they remain united and strengthen their defence capabilities at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the predictable period, largely rely on continued Western support.
